US Ends Automatic Renewal of Work Permits, Impact Likely on Indian Workforce

In a major policy shift, the United States has decided to end the automatic extension of Employment Authorisation Documents (EADs) for individuals applying to renew their work permits. The rule will take effect from October 30, 2025.

Until now, many foreign workers were allowed to continue employment even if their EAD had expired, as long as their renewal applications were submitted on time and their eligibility category remained unchanged. With the removal of this automatic extension, those applicants may face disruptions in employment if there are delays in processing their renewals.

The Department of Homeland Security (DHS) has stated that the move aims to strengthen monitoring and screening of authorised workers in the interest of public safety and national security.

Indian professionals are among the groups likely to feel the greatest impact, given their significant presence in the US workforce under visas that often require EADs — including those awaiting green cards through long-pending applications. Any lapse in employment authorisation could force affected workers to stop working until a renewal is approved.

According to DHS, people whose renewal filings are submitted before October 30, 2025, will continue to receive automatic extensions. The change will only apply to applications filed on or after the implementation date.

The new rule does not directly affect H-1B or L-1 visa holders, nor individuals who already hold US permanent residency. However, those in categories dependent on EADs are being advised to apply for renewals as early as 180 days prior to expiration to avoid any disruption.
